We spoke in April of 2009 regarding trying to get a loan Modification from
B of A. You seemed to me to be very passionate about helping people with this situation at the time and it appears that you still are.
Our home is in Phoenix AZ it has an option arm with a Balance of $615k plus 39k in arears, total they show now is $651k, the option payment went from 2,300 to 2,750 in April 08.
I was injured and out of work in July 08. We were unable to continue paying our mortgage and started looking into modification. Since then I am working but my income is half of what it used to be. We have a second as well at $76k that b of a sold to a company called Cenlar and we are not paying on that until we have a resolution on our first. The home is Valued today at $323k. ($727k total owed)
We were “told” that we were denied a HAMP mod Feb 12th 2011 but never received a letter to that effect. We are told now we are being considered for “in house” modification but no word right now.
Our sale date has been postponed monthly for that last 18 months and the next one is on April 26th 2011.
I have talked with a company out of CA, “Financial Restoration Alliance” that does Forensic Audits using the CFLA program “www.Certifiedforensicloanaudits.com” and would like me to pay them $2650 right now to do an audit for me.
But they sound like car salesmen and even the CFLA website says that private parties should not have this done, but should go through a LAW Firm who will do it and follow it up with Action, probably not a bad idea, although costly I would assume.
Our loan is an Option Arm/ Stated/Stated, Inflated Appraisal/no freddie or fannie/
No inflated fees that I can see , 1% loan origination etc
My income is Self employed P & L, at $8,200 per month gross personal, and would like to have a mortgage payment at around $1700-1900 fixed, plus tax and insurance, that would fit our budget and we want to stay in our home. I travel extensively for work and have rented it out on a weekly basis from time to time while we are going through this but this is my Primary Residence and all my mail comes here.
It looks like there are a lot of options out there with the screw up in The chain of ownership and the legal rights to foreclose etc..but it does not look like anyone has got anything done of real significance with Principal reductions or permanent Modification agreements, maybe I am wrong and maybe this is the time when it is all going to get some real solutions. With us it seems like they might be a little hesitant to offer anything until some things shake out with this foreclosure fiasco nationwide.
Tiffany, I do not know if there is anything you can offer for me right now but I would appreciate any advice you would have.
